Arctic Industries, LLC (“Arctic Industries,” “us,” “our,” or “we”) respects your privacy and is committed to protecting it through the practices described in this policy. This Privacy Policy (“Privacy Policy”) explains our information collection practices and the rights and choices that you have in relation to how we collect, use, retain, and disclose your Personal Information when you visit our top-level websites at www.arcticwalkins.com and mywalkinparts.com (each a “Website” and collectively, our “Websites”) or use Arctic Industries platforms, request Arctic Industries newsletters or other communications, visit our locations or Arctic Industries-hosted events, hire us to provide you products or services, or otherwise interact with us through channels where this Privacy Policy is posted (collectively, the “Services”). Terms that are capitalized are defined within this Privacy Policy.
Please note that this Privacy Policy is intended to apply where we control the collection of Personal Information and determine the purposes and means for its processing. Please read this Privacy Policy carefully to understand our policies and practices for collecting, using, and disclosing your Personal Information. - Information We Collect and How We Collect It
For purposes of this Privacy Policy, Personal Information means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, and may include Device, Internet and Network Information. Device, Internet, and Network Information refers to device, internet, and network activity information that we and our Service Providers may collect about your device or your online activity when you interact with our Websites or platforms. Personal Information does not include anonymous or deidentified data that is not associated with a particular individual, or information that is outside the scope of state consumer privacy laws, such as information protected by the Health Insurance Portability and Accountability Act or the Gramm-Leach-Bliley Act, and publicly available information.
We may collect one or more categories of Personal Information, including Sensitive Personal Information (as defined by applicable law) listed below. We will collect most of this Personal Information, including any Sensitive Personal Information, directly from you. However, we also collect Personal Information through Device, Internet and Network Activity and from other sources as described below. Information derived from Device, Internet, and Network Activity refers to device, internet, and network activity that we and our Service Partners and other business partners collect, including information about how you interact with our Services online.
We may collect the following categories of Personal Information and Device, Internet and Network Information about you in the course of business, including through your use of the Services or when you contact us, subscribe to our communications or otherwise request information from us:
- Identifiers and Contact Information, such as your name, mailing address, telephone number, email address, and social media account information.
- Financial Information, such as payment information, including credit or debit card information (collected by our payment processors only), or other bank account information.
- Professional or Employment Information, such as your employer’s name and job title, if you provide it when filling out a form on the Website.
- Commercial Information, such as records of purchasing habits from us.
- Geolocation Data, such as coarse geolocation through your ZIP code or IP address, or through physical location due to a visit to an Arctic Industries location.
- Audio, Electronic, or Visual Information, such as video surveillance at our physical locations. This video surveillance does not include any audio recordings.
- Other Service Information, such as information necessary to provide our Services to you, including information related to your employees, customers, service providers, or other third parties.
- Inferences or preferences we learn or infer about you from other information we have collected about you.
- Other information you choose to share with us.
We may supplement the information that you provide to us with information that we receive or obtain from other sources, such as our personnel, customers, professional advisors, partners, and agents, third parties with whom we interact, and publicly available sources.
Some of the above information may be considered Sensitive Personal Information (as defined by applicable laws in certain jurisdictions), and we may use information that you disclose to us to provide and support our Services, comply with our legal obligations, or defend against a legal claim. We do not collect or use Sensitive Personal Information for any other purposes.
Device, Internet and Network Activity Information
Personal Information derived from Device, Internet and Network Activity we collect may include:
Device Data, such as information about your computer, phone, tablet, or other device you use to access our Websites. Depending on the device used, this device data may include information such as your IP address, location, device and/or browser type, hardware model, internet service provider and/or mobile carrier, and system configuration information.
Log and Usage Data, including service-related, diagnostic, usage and performance information our servers automatically collect when you access or use our Websites and which we record in log files. Depending on how you interact with us, this log data may include information about your activity on the Website (such as data and time of your visit to our Websites), traffic data, referring/exit pages, error information, page clicks, and other communication data and the resources you access and use on the Websites. We may also collect information about your internet connection.
Information Provided by Other Sources
We may receive Personal Information about you from our Service Providers, data analytics and internet providers, and other third-party sources and commercially available sources. We may also collect publicly available information about you.
- Cookies and other Tracking Technologies
Like many businesses, we use cookies and other tracking technologies such as first party and third-party products and services to gather traffic statistics using cookies, pixels, plug-ins, or web beacons. A cookie is a small piece of information stored on your device that helps websites and servers recognize you. Arctic Industries, our Service Providers, and other third parties may also use other tracking technologies such as pixels or transparent GIF files for website management and visitor tracking.

- Pixel Tags, Web Beacons, and Transparent GIFs. Pixel tags and web beacons are small graphic images placed on our website pages or in our emails that allow us to determine whether you have performed a specific action. When you access these pages or open or click an email, the pixel tags and web beacons generate a notice of that action. These tools allow us to measure response to our communications and improve our web pages. Third parties may also use pixel tags and beacons to collect Personal Information to use in targeted advertising.
- Other Technologies. We collect many different types of information from other technologies to improve the quality of our website and the Services we provide. For example, we may collect usage data and other information about the device you use to access our websites, your operating system and/or mobile device type, browser type, domain, and other system settings, as well as the language your system uses and the country and time zone where your device is located.
We also use third-party plugins and widgets on our Websites to enable social media sharing tools, such as widgets for Facebook, Instagram, LinkedIn, and YouTube. These widgets may use automated means to collect information regarding your use of the Websites and your interaction with the plugins and widgets. The Websites are not designed to respond to general “Do Not Track” signals from browsers. - How We Use Your Information
We use your Personal Information, including information that also qualifies as Sensitive Personal Information, for our business purposes, including to provide and improve our Websites and Services, to respond to your inquiries and requests, to prevent fraud and other criminal activity, for marketing purposes, and for other purposes for which we may notify you. For example, we may use your Personal Information for the following and other purposes as permitted or required by law:
- Provision of our Services. We use information that you voluntarily provide to us before, during, and after we engage in a transaction or an order, such as identifiers, contact information, employers information (as applicable) and financial information in connection with your purchase from us and for billing and collection purposes.
- Maintenance of customer relationships: We use identifiers and contact information, financial information, and other service-related information to maintain our customer relationships, including to process invoices, deliver and customize our products, update customer records, and address customer inquiries or feedback.
- Sending relevant marketing/informational messages and customizing your experience on our Websites. We use identification data, contact details, Device, Internet, and Network Activity Information, and commercial information to communicate with you via email and social media postings to provide you with information about content or Services that may be of interest to you and to customize your experience on our Websites.

- With your consent. As described to you at the point of collection, we may use your Personal Information for other purposes with your consent, or as otherwise required or permitted by applicable laws.

We may disclose your Personal Information to the following categories of recipients:
- Our subsidiaries and affiliates, to assist us in providing or facilitating our Services to you and to improve and maintain our Services.
- To Service Providers used to provide or facilitate our Services. A Service Provider is an entity that performs functions on our behalf, and processes Personal Information on our behalf in connection with performing those functions in accordance with our instructions. For example, we may disclose information to our customer service, IT and infrastructure support, payment processing providers, professional service firms, data analytics, marketing, and shipping services, and general service providers such as office support, couriers, facilities management, and document destruction.

- We may disclose Personal Information as we believe to be necessary and appropriate, such as (i) as permitted by law; (ii) if we determine that the disclosure of specific information is necessary to comply with a request of a law enforcement or regulatory agency or other legal process; (iii) to protect the legitimate rights, privacy, property, interests or safety of our company or our affiliated entities’ customers, employees, or the general public; (iv) to pursue available remedies or limit damages; (v) to enforce our Terms of Use, Terms of Sale, or other applicable agreements, including for billing and collection; (vi) to respond to an emergency; and
- With other parties when we have your consent to do so.
We do not sell Personal Information about you in a traditional sense, but certain of our advertising and marketing activities may be considered a “sale” or a “sharing” of Personal Information about you for targeted advertising (called “cross-context behavioral advertising” under the CCPA). Targeted advertising involves seeking to place ads to you on third parties’ digital properties based, at least in part, on Personal Information obtained from your activity on others’ digital properties. Third parties that we allow to collect Personal Information directly from you may use it for targeted advertising, including by collecting information from you via cookies, pixels, and other automated tracking tools. We do not sell or share Sensitive Personal Information for any cross-context behavioral advertising or targeted advertising.
In addition, we may use deidentified or aggregated information to facilitate our business operations and for other legally permitted purposes. If we deidentify any Personal Information, we commit to maintain and use that data without attempting to reidentify it.

California residents have the following rights with respect to their Personal Information under the CCPA.
Right to Access Information. You may have the right to request access to your Personal Information and, where technically feasible, request a copy of your Personal Information. This includes the categories of Personal Information, the categories of sources of that Personal Information, our business or commercial purposes for collecting, selling, or sharing that Personal Information, the categories of third parties to whom we disclose Personal Information, and the specific pieces of Personal Information we have collected about you.
Right to Review and Correct Information. You may have the right to request that we correct any inaccurate or incomplete Personal Information we have about you.
Right to Delete Information: You may have the right to request that we delete your Personal Information. Please note that we may not be able to delete certain information depending on legal exceptions or obligations. Please see the Data Security and Retention section below for more information about why we may retain your information.
Right to Limit Use of Sensitive Personal Information. You have the right to request we limit the use of Sensitive Personal Information to only exempt purposes such as to provide the goods and services you requested, to prevent fraud, or verify or maintain the quality of goods or services we provide. We currently only use Sensitive Personal Information for such exempt purposes.
Right to Opt-Out of Marketing Communications. You may request that we not use your Personal Information to send you certain emails or other marketing communications. You may also unsubscribe from receiving marketing emails from us by clicking on the “Unsubscribe” link found in those emails or email us at privacy@arcticwalkins.com. Please note you may not be able to opt-out of all communications as we may need to send you information related to our Services.
Right to Opt-Out of Sale or Sharing / Targeted Advertising (Do Not Sell or Share My Personal Information Request). You may request to opt out of the “sale” or “sharing” of Personal Information. You may revoke your consent to the use of these cookies, including previously-enabled cookies, by blocking cookies through your browser, by modifying your cookies settings using the link in the Websites’ footer, or by following the instructions in the Exercising Your Rights section below to opt-out of the use of tracking technologies.
Your Right to Non-Discrimination. We will not discriminate against you for exercising any of your privacy rights or choices.
Exercising Your Rights

In order to protect your Personal Information, we may ask you to provide additional information to verify your identity for any access, deletion, or correction requests. You may also have the right to submit a request to exercise your rights through an authorized agent, in which case your agent must present signed written permission to act on your behalf. You may be required to independently verify your identity with us and confirm that you have provided authorization to the agent.

For example, we and certain third-party partners may place advertisements for our services on websites, apps, and platforms operated by others. If you would prefer not to receive certain interest-based advertising, you can opt-out of this activity at the Digital Advertising Alliance (DAA) website at optout.aboutads.info, optout.networkadvertising.org, optout.privacyrights.info, and www.aboutads.info/appchoices.

Our Services are not intended for use by any minors under the age of 18. We do not intend to collect Personal Information from anyone we know to be under the age of 16. If we learn that we have unknowingly collected or received Personal Information from an individual under the age of 16, we will make reasonable efforts to delete such information from our records.
